Flight Authorisations for UK Air Carriers

The European Union (EU) has published a regulation ("the Regulation") to lay down provisional measures to govern air services between the EU and the United Kingdom (UK) following the UK's withdrawal from the EU in a no-deal scenario:

Regulation (EU) 2019/502 on common rules ensuring basic air connectivity with regard to the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the Union

These measures are intended to maintain basic air connectivity and to facilitate the continuation of air services to and from the EU by UK air carriers.

The Regulation will apply until either:

  • The date on which a comprehensive agreement governing the provision of air transport with the UK, to which the EU is a party, enters into force or, as the case may be, is provisionally applied; or
  • The 30th of March 2020.

UK air carriers are required to have two types of authorisation in order to provide air services to and from EU Member States.

The first authorisation is an "Operating Authorisation", detailed in Article 10 of the Regulation. Upon receipt of this authorisation, a UK air carrier will be permitted to operate in Ireland while the Regulation continues to apply.

The second authorisation is referred to by the Department as the Services Authorisation, detailed in Article 11 of the Regulation. This authorisation requires UK air carriers to submit their operational plans, programmes and schedules for approval to each Member States' Aeronautical Authorities. UK air carriers are required to make a separate submission to the relevant Aeronautical Authorities for both the summer and winter 2019 seasons.

UK air carriers may submit multiple Services Authorisation forms, depending on the services they intend to offer.

Both the "Operating Authorisation" and Services Authorisation can be submitted together or separately, but both must be submitted in order to be permitted to provide air services.
